Dangerous goods are the goods that require a special approach and great caution in transportation. This type of transport is strictly regulated by many legal provisions. Any mistake in the transport of such goods can pose a serious risk not only to people, but also to the environment, property or general safety. Each carrier transporting dangerous goods is obliged to comply with a number of specific restrictions covering, among other things, the way in which the load is secured, packaged and labelled, the documentation or the necessary permits the carrier must have in order to provide transport services of dangerous goods. The way in which dangerous goods are handled depends largely on which group the goods are classified in.

Regulations concerning dangerous goods transport

International transport of dangerous goods is regulated by a comprehensive legal act called the ADR Agreement. Poland ratified the ADR Agreement in 1975.

The ADR agreement is not the only document that regulates the transport of dangerous goods. The following acts, documents and regulations should also be considered in its organisation:

  • the Act of 19 August 2011 on transport of dangerous goods,
  • Regulation of the Minister of Infrastructure of 25 October 2019 on the template form of the checklist and the template form of the inspection protocol (Journal of Laws 2019, item 2302),
  • Regulation of the Minister of Transport, Construction and Maritime Economy of 29 May 2012 on conducting courses in the field of dangerous goods (Journal of Laws of 2021, item 2150),
  • Announcement of the Minister of Infrastructure of 14 October 2021 on the publication of a consolidated text of the Regulation of the Minister of Transport, Construction and Maritime Economy on the certificate of approval for an ADR vehicle,
  • Regulation of the Minister of Infrastructure and Development of 7 May 2015 on obtaining the certificate of advisor for the safety of dangerous goods transport (Journal of Laws of 2023, item 84)
  • Regulation of the Minister of Transport, Construction and Maritime Economy of 15 February 2012 on examinations for drivers transporting dangerous goods (Journal of Laws of 2022, item 356),
  • Regulation of the Minister of Transport, Construction and Maritime Economy of 13 April 2012 on transportable pressure equipment (Journal of Laws, item 436)
  • Regulation of the Minister of Infrastructure of 2 June 2022 amending the Regulation on the template form of the annual activity report in the field of transport of dangerous goods and the manner of its completion (Journal of Laws of 2022, item 1227),
  • Announcement of the Minister of Infrastructure of 1 December 2022 on the publication of a consolidated text of the Regulation of the Minister of Transport, Construction and Maritime Economy on the template form of annual activity report in the field of transport of dangerous goods and the manner of its completion (Journal of Laws of 2023, item 24).

Types of dangerous goods

Dangerous goods are a broad group of products. Every carrier should be familiar with them in order to know whether to apply the rules of the ADR Convention, which sets out all the rules for the transport of dangerous goods by road. It is also good to be aware that not all dangerous materials and objects can be transported, and to most of them apply various restrictions.

Dangerous materials are divided into 9 classes (and they will largely determine the rules for the transport route and for securing the load):

  • explosive materials and objects,
  • gases,
  • liquid flammable materials,
  • solid flammable materials (self-reactive materials and desensitized solid explosives, self-igniting materials, materials producing flammable gases in contact with water),
  • oxidizing materials and organic peroxides,
  • poisonous and infectious materials,
  • radioactive materials,
  • corrosive materials,
  • various hazardous materials and objects.

Transport of dangerous goods by road requires great care and attention, as well as the need to comply with the ADR Agreement and Polish and international laws and directives on the transport of dangerous goods.

To ensure that ADR transport runs smoothly, it is very important to plan it properly. Transport of dangerous materials should follow special regulations and strict standards for ADR transport. It is essential in transport to select a suitable vehicle that is adapted in all respects to be used for ADR transport. Naturally, proper packing and securing the load should not be forgotten either.

Each transport, including ADR, requires the preparation of appropriate documents. Above all, there must be information sheets containing as much key information as possible concerning the dangerous goods being transported and ADR certificates. This type of transport, due to its nature, can only be carried out by drivers who have been properly trained for such transport.

Planning also includes the selection of the optimal route, taking into account any restrictions and risks that may arise on the road. When planning a driving route, it is also important to anticipate places where dangerous situations may occur and avoid them if possible.
